Legal status of parents in adoption Abstract The goal of this diploma thesis is the analysis of the Czech legal regulation of the position of the parent during an adoption. According to Act No. 89/2012 Coll., of the the Civil Code, essence of the adoption is primarily a status change in the legal status of the parent and child, which consists in the termination of family relationships, including obligations and rights to the adoptee's original family. The consequence of adoption is the termination of the relationship between parent and child, which is considered for the basic status relationship of family law. However, the termination of family relations will not occur in the case of adoption of an adult, which is not similar to the adoption of a underage. The first part of the thesis is briefly devoted to the concept of family, it reflects on its importance and a possible definition of this concept. The second part deals with parenthood in the legal sense, the purpose of this part is to determine to who can be considered as a parent in accordance with Czech legislation, to whom the parental duties and rights testify, and mainly who create the basic status relationship of parent and child. Analysis of Applicants for Substitute Family Care in the South Moravian Region from 2002 to 2009

The subject of this bachelor thesis is an analysis of applicants for foster care who participated in the preparation of mediated by civic associations Trialog in the years 2002 – 2009. The theoretical part contains the theory of foster care, time series and regression analysis. The practical part will focus on the analysis of indicators relating to applicants for foster care, find forecasts of further development of these indicators. Further evaluate the impact of the development indicators of the number of applicants on the financial situation of the civic association. The practical part will summarize and explain the conclusion and suggestions based on findings from the practical part.
Parenthood in lesbian families

This bachelor thesis deals with same-sex parenting among lesbian couples and its process. In the Czech Republic, it is possible for same-sex couples to enter into a registered partnership, although there is no option of starting families with children together under the same legal protection that heterosexual couples have. On the contrary, there is no legislation concerning this issue. That is why, although same-sex parenting is not explicitly banned, the state and society show no basic degree of acceptance of this alternative family form. That puts lesbian couples into unique circumstances, which they encounter on their way to and during parenthood. The aim of this thesis is to analyse the current situation of lesbian families in the Czech Republic using available literature and other sources. The thesis discusses the topics of the perception of homosexuality and same-sex parenting in the Czech society, the means of obtaining custody of a child and which ones are available, and what accompanying problems lesbian couples deal with on their way to parenthood. 1 Consent to adoption of minor Abstract The diploma thesis deals with current legal regulation of consent to adoption. The thesis is divided into six parts, in which the regulation of consent to adoption in Czech legal system is discussed, with the aim to provide comprehensive explanation of consent to adoption. In the first part, the author deals with the adoption in general. Author explains the basic terms that are key for understanding the issue itself, namely child, child available for adoption, best interest of the child. Author also discusses the requirements to adopt a child and the process of adoption. The author also focusses on international treaties that govern an adoption. The second part deals with the legal regulation of parental consent and mention specific reasons when parental consent for adoption is not required. The consent of parent of the adopted child is also discussed with the regard to the status of parent suffering from a mental disorder, as well as the parent with no capacity to act. Author also discusses the consent of adopted child regarding to participation rights of a child. Finally, the author discusses the consent of adoptive parent's spouse. Specifics of education of children in foster care

The main focus of the thesis is upbringing and education of the children in the substitute family care. This thesis is divided into theoretical part and practical part. The theoretical part is describing types of the substitute family care in the Czech Republic, institutional care, perils of the development of the children in the substitute family care, consequences of the missing family care and cooperation of the substitute family with school. The practical part is focused on the important factors, supporting factors and difficult situations, which may be sensed by parents and teachers during upbringing and education of the children in the substitute family care. Then it is focused on the cooperation of the substitute families with teachers and readiness of the teachers to educate the children in the substitute family care. There are three case studies engaged to the practical part. Mainly, they are dealing with the process of coming of child to family, upbringing and operating of the child in school.
Benefit of transition period forster care for the following adoption

The bachelor thesis deals with the benefit of temporary period foster care for the following adoption. The theoretical part introduces to the reader the substitude forms of family care, clarifies the legislative scope, compares foster care for temporary period with institutional care in the basics, mentions pros, cons and possible faults. The theoretical part introduces the term of adoption at the end. The practical part compares issue of adoptive families, which adopt the child from the institutional care or from the foster care for temporary period. There is the summary of the most common aspects both types of care from the adopters views. The answers are focused on pros and cons of the institutional care and the foster care for temporary period in the contex of following adoption and reflects the family lives with these children. The results represents the pros of the handing over the child from family to family against the cons of the handing over the child form the institutional care.
Babybox as a part of our society: Opinions of parents in Pelhřimov region on a postponing of a nearly two-year-old child to a babybox in Pelhřimov Hospital.

This thesis is divided into theoretical and practical part. In the theoretical part, I focused on the basic theory of babyboxes, their history, location, usability and the rationale behind putting unwanted children into babyboxes. Foster care and adoption are also looked at. In the conclusion of the theoretical part I discuss possible preventive measures and some ethical issues related to this topic. For the practical part I have used qualitative research. I asked questions of five pre-selected interviewees from the Pelhřimov region concerning their opinion on babyboxes and babyboxes located in Pelhřimov Hospital. I held a semi-structured interview with Mr. Ludwig Hess. He is the founder of babyboxes in the Czech Republic. He provided an opinion of one that was used on a boy of nearly two years of age at Pelhřimov Hospital. The aim of this thesis is to find out the opinions of selected interviewees about babyboxes and the motivation behind their use on a two-year-old child. I compare the obtained data with my opinion and with the opinion of Mr. Ludwig Hess.
Surrogacy in the Czech Republic - the responsibility and competence of midwives and doctors

This Bachelor thesis is about surrogacy and consists of theoretical and practical part. The theoretical part is focused on the topic of infertility and assisted reproduction, mainly by the issue of assisted reprodution in surrogacy. It is also focused on legislation of surrogacy and assisted reproduction, the ethical part of surrogacy and on questions that arise for de lege ferenda debates. The main aim of this thesis is to sum up knowledge about surrogacy into well-arranged chapters and by that to raise the awarness about surrogacy in professional but also wider public. The next aim is to find out the knowledge and attitude of midwives from labour rooms, from the department of puerperium and the department of physiological newborns and to make few reflections about the attitude of the staff to surrogacy. One of the last aims of this thesis is to suggest a manual for care procedure about surrogate mother, the infertile couple and the baby. For the practical part of the Bachelor thesis was used a questionnaire and was performed since 1st of February 2022 until 31st of March 2022 towards the whole Czech republic. Resumé The topic of this master thesis is selected issues of an adoption (comparative fragments). I chose not to deal with the theme as a whole because of its extent, which would have inevitably lead to mere scratch of the surface of such complex issue as an adoption. Picking and choosing some interesting aspects enabled me to go more into detail and elaborate on them in depth. When approaching this thesis I chose to use combination of analytic and comparative method. The thesis itself is composed of the introduction, six chapters and the conclusion. The purpose of the Introduction is to make the reader aware of the structure of the thesis and to outline the complicated legal nature of adoption. The objective of this thesis, which is also announced within this section, is to provide the reader with issues not usually dealt with within theses or academic works. Chapter One is divided into three parts and subsequently shed light into the concept of the adoption, its types and sources of the legislative.
